Acceptance of Terms

Privacy Policy

Resourceful Soul’s privacy policy is expressly incorporated into this Agreement by this reference.

Refund Policy

All Resourceful Soul products and or services are subject to our refund policy, which can be accessed by clicking the “Refund Policy” link at the bottom of this page. Resourceful Soul’s refund policy is expressly incorporated into this Agreement by this reference.

The products sold by Resourceful Soul are all virtual downloads and cannot be “returned.” Due to the nature of our products, and in an effort to treat all of our customers equally, we have set forth the following refund policy.

Resourceful Soul and its owners do not and will not provide any refunds on any sales and or purchases. This means sales and or purchases made through resourcefulsoul.com are not eligible for refunds under any circumstance, and ALL SALES ARE FINAL.

We do not and will not make any exceptions to our refund policy. Resourceful Soul and its owners have adopted this refund policy to refrain from passing bias or impartial judgment on various individual situations and deciding which cases are “genuine” and or “fair.”

Any requests received regarding refunds will be subject to this refund policy. NO REFUNDS will be given.

Mandatory Arbitration and Governing Law

You expressly waive your right to bring any legal claims, now or in the future arising out of or related to the website and our products/services. In the event of any dispute, claim or controversy arising out of or relating to your use of this website, the terms and conditions shall be construed in accordance with the rules and regulations of the state of Texas and United States. You agree to consent and submit to the jurisdiction of the state and federal courts located in San Antonio, Texas without regard to the principles of conflict of law or where the parties are located at the time a dispute arises. You agree to resolve any disputes or claims first through mandatory arbitration in the state of Texas and shall bear the full cost of arbitration as permitted by law. You also agree that in the event a legal claim is initiated after the required arbitration, the prevailing party shall be entitled to recover reasonable attorney’s fees and other costs associated with the legal action.

Age

Use of Software

Resourceful Soul may make certain software available to you from the Site.  If you download software from the Site, the software, including all files and images contained in or generated by the software, and accompanying data (collectively, “Software”) are deemed to be licensed to you by Resourceful Soul, for your personal, noncommercial, home use only.  Resourceful Soul does not transfer either the title or the intellectual property rights to the Software, and Company retains full and complete title to the Software as well as all intellectual property rights therein.  You may not sell, redistribute, or reproduce the Software, nor may you decompile, reverse-engineer, disassemble, or otherwise convert the Software to a human-perceivable form.  All trademarks and logos are owned by Resourceful Soul or its licensors and you may not copy or use them in any manner.

User Content

You grant Resourceful Soul a license to use the materials you post to the Site or Service. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content (“User Content”) to the Site or Service, you are granting Resourceful Soul, its affiliates, officers, directors, employees, consultants, agents, and representatives a license to use User Content in connection with the operation of the Internet business of Resourceful Soul, its affiliates, officers, directors, employees, consultants, agents, and representatives, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content. Alleged Violations

Resourceful Soul and its owners reserves the right to terminate your use of the Service and/or the Site. To ensure that Resourceful Soul and its owners provides a high quality experience for you and for other users of the Site and the Service, you agree that Resourceful Soul and its owners or its representatives may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorized uses of the Site or the Service.
